The Andhra Pradesh Electricity Regulatory Commission (APERC) on June 08, 2026, issued directions based on concerns raised by APEPDCL regarding large unpaid dues (around ₹850 crore) by certain consumers and generators seeking Open Access. The Commission examined the issue under the APERC Open Access Regulations, 2005 and the Green Energy Open Access Regulations, 2024, and emphasized that the dues status of applicants is a crucial factor in processing Open Access requests.
The Commission observed that existing regulations already allow consultation with distribution licensees and permit seeking relevant information, including outstanding dues, disputed claims, and cases of unauthorized electricity use or theft. It also noted that under the 2024 regulations, entities with insolvency status, pending theft cases, or undisputed dues exceeding two months are not eligible for Open Access.
Accordingly, APERC mandated that a No Dues Certificate from the concerned distribution licensee is compulsory for processing Short-Term Open Access applications by APSLDC, along with technical feasibility. If the licensee fails to provide the certificate within the prescribed timeline, it will be deemed that no dues exist. Further, applicants with significant undisputed dues, insolvency status, or pending electricity misuse/theft cases are ineligible for Open Access unless protected by a court or tribunal order.
Overall, the order aims to safeguard the financial interests of distribution licensees and prevent undue burden on other consumers by ensuring that only financially compliant entities are granted access to the electricity transmission and distribution network.
